R.E.T Conveyancing ("we", "us", "our") is a conveyancing practice at 262 St Kilda Road, St Kilda VIC 3182. This policy explains what personal information we collect, why we collect it, how we look after it, and how you can access or correct it. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

This policy covers the personal information we collect through this website, www.retconveyancing.com.au, and when we act for you on a property matter.

The information we collect

When you contact us or send us a contract to review

When you send an enquiry, refer a client to us, or upload a contract for review, we collect:

• your name, email address and phone number
• the property address and the service you're interested in
• your message, and how you heard about us
• the documents you upload, such as a contract of sale or a Section 32 vendor statement
• when you need a contract review back by.

When you complete one of our questionnaires

Our purchase, sale, transferee and transferor questionnaires collect what we need to act on your matter. Depending on the questionnaire, this includes:

• your name, email address, phone number, residential or postal address and date of birth
• whether you're buying as an individual, a company or a trust, and the company or trust name and its ABN or ACN
• details of the property, such as its title reference, whether it's tenanted, owners corporation details, outstanding rates or notices, and any building works or permits
• details of the contract or transfer, such as the price, the settlement date, the selling agent, the share being transferred and the reason for the transfer
• details of any mortgage, such as the lender and the loan reference, and where the funds for a purchase are coming from
• for a sale, or a transfer where proceeds are payable, the name, BSB and number of the bank account the proceeds are to be paid into
• whether you choose to apply for title insurance
• the documents you attach, such as a contract or an identity document
• the name you type in place of a signature, with the date, time and internet (IP) address the questionnaire was sent from.

Information about other people

Sometimes you'll give us information about someone else, such as a co-purchaser, a co-vendor, or a client you're referring to us. Please only do this if they know you're sharing it with us and have agreed to it.

Information collected automatically

When you visit this website, we and our service providers collect information about your visit, such as the pages you view, the buttons and links you click, the website that referred you, your browser and device, and your approximate location. We use Google Analytics and the Meta Pixel to do this (see "Cookies and analytics" below). When you send a form, we also record the internet (IP) address it was sent from.

Information from others

When we act for you, we may also collect information about you from other people involved in your matter, such as the other party's representative, real estate agents, and your lender or mortgage broker. We also collect it from public sources such as the Victorian land titles register, councils and the State Revenue Office.

Why we collect it and how we use it

We collect, hold, use and disclose personal information to:

• respond to your enquiry and give you a quote
• review a contract or Section 32 you send us
• verify your identity when we act for you
• act on your instructions and complete your matter, including preparing documents, carrying out searches, arranging settlement and paying out settlement funds
• arrange title insurance through Stewart Title, if you choose to apply for it
• meet our legal and professional obligations
• invoice you and keep our records
• understand how visitors use this website, improve it, and measure how our advertising performs.

If you don't give us the information we ask for, we may not be able to act for you.

Who we share it with

We share personal information only as needed for the purposes above, with:

• the other parties to your transaction and their representatives
• the real estate agents, lenders and mortgage brokers involved in your matter
• PEXA, the electronic settlement platform, and Land Use Victoria
• the State Revenue Office, councils, water authorities and owners corporations
• Stewart Title, if you choose to apply for title insurance
• conveyancing solicitors we work with when a matter needs one
• our service providers, such as our website developer and hosting provider, our email provider, Cloudflare (which delivers this website), Google and Meta
• anyone we're required or authorised by law to share it with.

We don't sell your personal information.

Overseas

Some of the services this website uses store or process information outside Australia. Google (Google Analytics and Google Maps), Meta (the Meta Pixel), Calendly (our booking calendar) and Cloudflare are based in the United States and may handle information there and in other countries.

Cookies and analytics

This website uses:

• Google Analytics, which uses cookies to tell us how visitors find and use the site
• the Meta Pixel, which tells Meta (the company behind Facebook and Instagram) which pages you visit, so we can measure how our advertising performs and show our ads to people who have visited the site
• Calendly, which shows our booking calendar on the home page and may set its own cookies
• Google Maps, which shows our office on the contact page.

You can block or delete cookies in your browser's settings. Google offers a browser add-on that stops Google Analytics collecting information about your visits (tools.google.com/dlpage/gaoptout), and you can manage the ads you see in your Facebook and Instagram settings. Blocking cookies won't stop you using this website or sending us a form.

How we store and protect it

• Every page of this website is sent over an encrypted (HTTPS) connection.
• Documents you upload are kept in private storage that can't be reached from the internet, and every file is scanned for viruses when it arrives.
• When you send a form, a copy of it, with any documents you attached, is emailed to our office so we can act on it.
• The website deletes form submissions, and the documents attached to them, 180 days after they're sent. A file you upload but don't send is deleted about 6 hours later.
• The records of your matter, including the copies emailed to our office, are stored in a secure, cloud-based digital system and kept for 7 years.

We'll never email you asking you to change the bank account your settlement proceeds are paid into. If you receive a message like that, call us on (03) 9534 3422 before you act on it.

If a data breach involving your personal information is likely to cause you serious harm, we'll tell you and the Office of the Australian Information Commissioner, as the Privacy Act requires.

Accessing and correcting your information

You can ask for the personal information we hold about you, and ask us to correct anything that's wrong, out of date or incomplete. Contact us using the details below. We'll need to confirm your identity first, and we'll respond within 30 days. If we can't give you access, we'll tell you why.

Complaints

If you think we've mishandled your personal information, please contact us using the details below. We'll acknowledge your complaint promptly and aim to resolve it within 30 days. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.

Changes to this policy

We may update this policy from time to time. The current version is always on this page, with the date it was last updated.
